These Terms and Conditions govern your access to and use of the Chango mobile application, website, ordering platform, transport booking services, delivery services, and related features operated by CHANGO DELIVERY CO., LTD.

By using Chango, creating an account, placing an order, booking a service, making a payment, or accessing our website or app, you agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use Chango.


1. About Chango

Chango is a local delivery and transport platform operating in Thailand. Through the Chango app and website, customers may access services including:

  • Food ordering and restaurant delivery
  • Parcel delivery
  • Motorbike taxi bookings
  • Private taxi and transfer bookings
  • Other related local delivery, transport, and convenience services that may be added from time to time

Chango acts as a technology platform that connects customers with restaurants, merchants, drivers, delivery partners, and transport providers. In some cases, services may be provided directly by Chango or by third-party service providers working with Chango.

3. Eligibility to Use Chango

To use Chango, you must:

  • Be at least 18 years old, or have permission from a parent or legal guardian
  • Provide accurate, complete, and current information when creating an account or placing an order
  • Use the platform only for lawful purposes
  • Not misuse, disrupt, damage, or interfere with the platform or its services

Chango may refuse service, suspend accounts, cancel orders, or restrict access where we believe there has been misuse, fraud, abuse, unlawful activity, or a breach of these Terms.


4. User Accounts

You may need to create an account to access certain Chango services.

You are responsible for:

  • Keeping your login details secure
  • Ensuring your account information is accurate
  • Updating your phone number, delivery address, payment details, and contact information when needed
  • All activity that occurs under your account

You must not create fake accounts, impersonate another person, use another person’s payment method without permission, or use Chango for fraudulent activity.


5. Orders and Bookings

When you place an order or make a booking through Chango, you agree to provide accurate information, including:

  • Delivery or pickup location
  • Contact name and phone number
  • Order details
  • Booking time, where applicable
  • Passenger count, where applicable
  • Any special instructions

Chango, restaurants, merchants, drivers, or transport providers may reject, cancel, or adjust an order or booking if:

  • Items are unavailable
  • The location is outside the service area
  • The customer cannot be contacted
  • Payment fails
  • The order appears fraudulent or suspicious
  • Weather, road, ferry, traffic, safety, or operational conditions prevent fulfilment
  • The request breaches these Terms or applicable law

Estimated delivery times, pickup times, arrival times, and travel times are estimates only and are not guaranteed.


6. Food Orders

For food orders, menu items, prices, availability, images, descriptions, ingredients, and preparation times are provided by restaurants or merchants.

Chango aims to keep information accurate, but we do not guarantee that all menu details are always complete, current, or error-free.

Customers are responsible for reviewing order details before confirming payment.

If you have food allergies, dietary requirements, or ingredient restrictions, you must contact the restaurant directly or clearly state your request before placing the order. Chango cannot guarantee that restaurants can accommodate all allergy, dietary, or preparation requests.


7. Parcel Delivery

Parcel delivery may be used only for lawful, safe, and permitted items.

Customers must ensure that parcels are properly packed and suitable for delivery by motorbike, car, or other available transport.

Chango may refuse or cancel parcel delivery requests where the item is unsafe, illegal, restricted, fragile without suitable packaging, too large, too heavy, or otherwise unsuitable for delivery.

Chango may request additional information about a parcel before accepting or completing delivery.


8. Transport Services

Chango may allow users to book motorbike taxis, private taxis, transfers, or other transport services.

Customers must provide accurate pickup and destination details. For private taxi or transfer bookings, customers must also provide accurate passenger numbers, luggage details, and any relevant timing requirements.

Drivers and transport providers may refuse or cancel a booking where:

  • The customer is unreachable
  • The pickup location is incorrect or unsafe
  • The passenger count exceeds the selected vehicle capacity
  • The customer behaves abusively, dangerously, or unlawfully
  • Weather, road, ferry, traffic, or safety conditions prevent the trip
  • The customer attempts to transport prohibited or unsafe goods

Customers must follow driver safety instructions and comply with local laws at all times.


9. Pricing, Fees, and Charges

Prices shown in the Chango app or website may include one or more of the following:

  • Item price
  • Delivery fee
  • Transport fare
  • Service fee
  • Platform fee
  • Distance-based fee
  • Waiting fee
  • Cancellation fee
  • Additional charges for special requests
  • Taxes, where applicable

Prices may vary based on distance, time, location, demand, service type, merchant pricing, operational costs, or other factors.

The total amount payable will be shown before you confirm your order or booking, unless additional fees become applicable due to changes requested by you, waiting time, incorrect information, route changes, extra stops, or other circumstances.


10. Payments

Chango may accept payment through supported payment methods, including but not limited to:

  • Debit cards
  • Credit cards
  • Bank transfer
  • QR payment
  • E-wallets
  • Cash, where available
  • Other approved payment methods added in the future

Available payment methods may vary by service type, location, customer account, or operational availability.

By selecting a payment method, you confirm that:

  • You are authorised to use that payment method
  • The payment information provided is accurate
  • You authorise Chango and its payment service providers to process the payment
  • You agree to pay the full amount shown at checkout or booking confirmation

Payments may be processed by regulated third-party payment service providers. Chango does not store full card details unless this is supported by an authorised payment provider and permitted by applicable law.

If payment fails, Chango may cancel the order, suspend fulfilment, request another payment method, or recover outstanding amounts from you.


11. Payment Verification and Fraud Prevention

To protect customers, merchants, drivers, and Chango, we may conduct checks before accepting or completing an order, booking, refund, or payment.

Chango may delay, cancel, or refuse transactions where we suspect:

  • Unauthorised payment use
  • Fraud
  • Chargeback abuse
  • False account information
  • Suspicious order behaviour
  • Misuse of promotions
  • Breach of these Terms
  • Activity that may violate applicable law or payment provider requirements

We may request additional verification before processing certain transactions.


12. Cancellations

Cancellation rules may vary by service type.

Food Orders

A food order may not be cancellable once the restaurant has accepted the order or started preparing the food.

If a customer cancels after preparation has started, the customer may still be charged in full or in part.

Parcel Delivery

Parcel delivery may be cancelled before a driver has been assigned or before pickup has occurred.

If a driver has already travelled to the pickup location, a cancellation fee may apply.

Motorbike Taxi and Private Taxi Bookings

Transport bookings may be cancelled before driver assignment or before the driver begins travelling to the pickup location.

A cancellation fee may apply where:

  • A driver has already been assigned
  • The driver is already travelling to the pickup location
  • The customer is late or unreachable
  • The customer provides incorrect pickup details
  • The cancellation occurs close to the scheduled pickup time

Chango will display cancellation information where possible before you confirm cancellation.


13. Refund Policy

Refunds are handled in accordance with Chango’s Refund Policy.

A refund may be considered where:

  • The order was not delivered
  • The wrong item was delivered
  • An item was missing
  • The merchant cancelled the order
  • The driver or service provider cancelled the booking
  • A duplicate payment was made
  • A technical or payment processing error occurred
  • Chango determines that a refund is appropriate after review

A refund may not be available where:

  • The customer provided incorrect delivery or pickup details
  • The customer was unreachable
  • The order was prepared correctly but the customer changed their mind
  • The customer cancelled after preparation, dispatch, or driver assignment
  • The issue was caused by the customer’s failure to provide accurate information
  • The request is fraudulent, abusive, or unsupported by evidence

Refunds may be issued to the original payment method, as app credit, or through another method approved by Chango.

Refund processing times may vary depending on the payment method, bank, card issuer, payment provider, or financial institution.


14. Chargebacks and Payment Disputes

If you believe a payment was made in error, you should contact Chango support first so we can investigate and resolve the issue.

If you raise a chargeback or payment dispute with your bank or card issuer, Chango may provide transaction records, order details, delivery evidence, communication logs, refund records, and other relevant information to assist with the investigation.

Chango may suspend or restrict accounts that submit false, abusive, or repeated chargebacks.


15. Promotions, Discounts, and Credits

Chango may offer promotions, discount codes, vouchers, referral rewards, loyalty rewards, or app credits.

Promotions may be subject to additional terms, including:

  • Expiry dates
  • Minimum order values
  • Service area restrictions
  • Merchant restrictions
  • One-time use limits
  • New customer restrictions
  • Payment method restrictions
  • Non-transferability

Chango may cancel, withdraw, or refuse promotions where we suspect misuse, fraud, duplicate accounts, or breach of these Terms.

Promotional credits have no cash value unless required by law.


16. Prohibited Goods and Services

Chango must not be used to order, deliver, transport, arrange, or pay for illegal, unsafe, restricted, or prohibited goods or services.

Prohibited items and activities include, but are not limited to:

  • Illegal drugs or controlled substances
  • Weapons, firearms, ammunition, explosives, or dangerous items
  • Stolen goods
  • Counterfeit goods
  • Hazardous chemicals or toxic substances
  • Human remains or body parts
  • Live animals, unless expressly approved by Chango
  • Pornographic or sexually exploitative material
  • Goods or services connected to fraud, scams, money laundering, or illegal activity
  • Items that violate Thai law or applicable regulations
  • Any item restricted by Chango, its payment providers, banks, financial partners, logistics partners, or applicable law

Chango may refuse, cancel, report, or cooperate with authorities in relation to any transaction that appears to involve prohibited goods, restricted services, fraud, abuse, or unlawful activity.


17. Customer Conduct

When using Chango, you agree not to:

  • Abuse, threaten, harass, or discriminate against drivers, merchants, staff, or other users
  • Provide false or misleading information
  • Use another person’s account or payment method without permission
  • Make fraudulent orders or bookings
  • Damage, misuse, or interfere with the app, website, or platform
  • Attempt to reverse engineer, scrape, copy, or exploit the platform
  • Use Chango for illegal, unsafe, or unauthorised purposes
  • Circumvent fees, payment systems, or platform rules
  • Create multiple accounts to misuse promotions or avoid restrictions

Chango may suspend, restrict, or terminate access where we believe a user has breached these rules.


18. Merchant, Restaurant, Driver, and Third-Party Services

Some services available through Chango are provided by independent restaurants, merchants, drivers, transport providers, or third-party partners.

Chango may assist with communication, payment, booking, delivery coordination, and dispute handling. However, merchants and service providers remain responsible for the goods or services they provide, including food preparation, item quality, legal compliance, safe transport, and accurate service fulfilment.

Chango is not responsible for delays, quality issues, availability issues, or service failures caused by third-party providers, except where required by applicable law or where Chango determines that compensation, credit, or refund is appropriate.


19. Availability of the Platform

Chango aims to keep the app, website, and services available and reliable. However, we do not guarantee uninterrupted access.

The platform may be unavailable or limited due to:

  • Maintenance
  • Technical issues
  • Internet or network problems
  • Payment provider issues
  • Weather or operational disruption
  • Driver or merchant availability
  • System upgrades
  • Events outside our reasonable control

Chango may update, modify, suspend, remove, or discontinue any part of the platform or services at any time.


20. App Updates and Changes

Chango may release app updates, new features, service changes, design changes, pricing changes, or policy updates from time to time.

Some features may require you to update the app to continue using the service.

Chango may add, remove, test, or limit features based on location, service type, operational needs, or business requirements.


21. Privacy and Personal Data

Chango collects and uses personal data in accordance with its Privacy Policy.

This may include information such as:

  • Name
  • Phone number
  • Email address
  • Delivery address
  • Location information
  • Payment-related information
  • Order history
  • Booking history
  • Device information
  • Customer support communications

We use this information to provide services, process payments, fulfil orders, improve safety, prevent fraud, support customers, and comply with legal obligations.

22. Location Data

Some Chango services require access to location data, including delivery, driver tracking, pickup coordination, and transport booking.

By using location-based services, you agree that Chango may collect and use location information to provide and improve the service.

You may disable location permissions through your device settings, but some features may not work correctly without location access.


23. Intellectual Property

The Chango name, logo, app design, website design, platform content, graphics, icons, software, text, features, and related intellectual property belong to Chango or its licensors.

You may not copy, reproduce, modify, distribute, sell, reverse engineer, or use Chango’s intellectual property without written permission.

You are granted a limited, non-exclusive, non-transferable licence to use the Chango app and website for personal, lawful use in accordance with these Terms.


24. Limitation of Liability

To the maximum extent permitted by law, Chango is not liable for:

  • Indirect, incidental, special, or consequential losses
  • Loss of profit, revenue, data, goodwill, or business opportunity
  • Delays caused by traffic, weather, ferry schedules, road conditions, accidents, or operational disruption
  • Actions, omissions, or failures of third-party merchants, drivers, service providers, banks, payment providers, or network operators
  • User errors, incorrect addresses, unreachable customers, or inaccurate booking details
  • Unauthorised account access caused by the user’s failure to protect login details

Nothing in these Terms limits liability that cannot be excluded under applicable law.


25. Indemnity

You agree to indemnify and hold Chango, its directors, officers, employees, contractors, partners, merchants, drivers, and service providers harmless from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your breach of these Terms
  • Your misuse of the platform
  • Your violation of applicable law
  • Your fraud, negligence, or misconduct
  • Your infringement of third-party rights
  • Your use of Chango to request prohibited, unsafe, or unlawful goods or services

26. Account Suspension or Termination

Chango may suspend, restrict, or terminate your account or access to services if:

  • You breach these Terms
  • You misuse the platform
  • You provide false information
  • You engage in fraud or suspicious activity
  • You abuse staff, drivers, merchants, or other users
  • You fail to pay amounts owed
  • Required by law, regulators, banks, payment providers, or authorities
  • Continued access may create risk for Chango, users, merchants, drivers, or partners

You may stop using Chango at any time.


27. Complaints and Dispute Resolution

If you have a complaint or dispute, please contact Chango support first.

We will aim to review complaints fairly and may request:

  • Order number or booking reference
  • Payment receipt
  • Photos or screenshots
  • Communication records
  • Delivery details
  • Other supporting evidence

We will use reasonable efforts to resolve issues quickly and fairly.


28. Governing Law

These Terms are governed by the laws of Thailand.

Any dispute arising from or relating to these Terms, the Chango platform, or Chango services shall be handled in accordance with applicable Thai law and, where necessary, submitted to the competent courts or dispute resolution bodies in Thailand.


29. Changes to These Terms

Chango may update these Terms from time to time.

The updated version will be posted on the Chango app, website, or other official channel. The “Last updated” date will be revised when changes are made.

By continuing to use Chango after changes are posted, you agree to the updated Terms.
